Terms of Agreement for MOPC Network

Welcome to MOPC Network (“Provider,” “we,” “our,” or “us”). By subscribing to or using our internet services (“Service”), you (“Customer” or “you”) agree to the following terms and conditions (“Agreement”). If you do not agree, please do not use the Service. 

1. Service Description 

1.1 Scope: We provide internet connectivity and related services as outlined in your plan. The speed and availability of Service may vary based on location, network conditions, and your selected plan. 

1.2 Acceptable Use: You agree to use the Service for lawful purposes and in accordance with our Acceptable Use Policy (“AUP”), which prohibits: 

• Illegal activities (e.g., hacking, piracy). 

• Sending spam or malicious software. 

• Excessive bandwidth consumption beyond reasonable limits as defined in your plan. 

2. Customer Obligations 

2.1 Equipment: You are responsible for maintaining and protecting any equipment provided by us, including modems or routers. Equipment must be returned upon termination of Service, or you may be charged a replacement fee. 

2.2 Account Responsibility: You are responsible for all activity on your account and ensuring the security of your login credentials. Notify us immediately of any unauthorized use. 

2.3 Payment: You agree to pay all fees for the Service as outlined in your plan. Payments are due on the invoice date or as specified. Late payments may result in additional fees or suspension of Service. 

3. Service Limitations and Disclaimers 

3.1 Availability: Service availability is not guaranteed. Interruptions may occur due to maintenance, network conditions, or other factors. 

3.2 Speed: Advertised speeds are “up to” maximums and may vary depending on your location, equipment, and usage. 

3.3 Force Majeure: We are not liable for Service disruptions caused by events beyond our reasonable control, such as natural disasters, power outages, or government actions. 

4. Privacy and Data Usage 

4.1 Customer Data: We collect and use your data in accordance with our Privacy Policy, available at www.mopcnetwork.ca. 

4.2 Law Enforcement: We may disclose your data if required by law or lawful request from authorities. 

5. Term and Termination 

5.1 Term: This Agreement begins when you accept it and continues until terminated by either Party. 

5.2 Termination by Customer: You may cancel the Service at any time by providing notice in accordance with our cancellation policy. Early termination fees may apply if specified in your plan. 

5.3 Termination by Provider: We may terminate or suspend your Service if: 

• You fail to comply with this Agreement. 

• Non-payment occurs. 

• You violate the AUP or applicable laws. 

6. Billing and Fees 

6.1 Billing Cycle: Your billing cycle begins on the activation date of the Service. Invoices are issued monthly unless specified otherwise. 

6.2 Taxes and Fees: You are responsible for all applicable taxes, fees, and surcharges. 

6.3 Late Payments: A late fee of 2% may be applied to overdue accounts monthly. Continued non-payment may result in Service suspension or termination. 

6.4 Refunds: Refunds are only issued in accordance with our refund policy, which may vary by plan or promotion. 

7. Limitation of Liability 

To the maximum extent permitted by law, we are not liable for: 

• Any indirect, incidental, or consequential damages arising from Service use. 

• Loss of data, profits, or business due to Service interruptions or errors. 

Our total liability under this Agreement is limited to the amount you paid us in the last three months. 

8. Indemnification 

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising out of your use of the Service, violation of this Agreement, or misuse of the equipment. 

9. Modifications to this Agreement 

We reserve the right to modify this Agreement at any time. Changes will be posted on our website or communicated directly. Continued use of the Service constitutes acceptance of the updated terms. 

10. Governing Law and Dispute Resolution 

10.1 Governing Law: This Agreement is governed by the laws of the Province of Nova Scotia and Government of Canada. 

10.2 Dispute Resolution: Disputes will first be resolved through good-faith negotiations. If unresolved, disputes may be submitted to arbitration or a court in Nova Scotia as agreed. 

11. Miscellaneous 

11.1 Entire Agreement: This Agreement, along with any associated policies or terms, constitutes the entire agreement between the Parties. 

11.2 Severability: If any provision is found to be unenforceable, the remaining provisions remain in effect. 

11.3 Assignment: You may not assign this Agreement without our consent.
